Rockpoint provides wireless internet access as a convenience to guests and visitors. By accessing or using this wireless network (the “Service”), you acknowledge and agree to the following Terms of Use.
Use at Your Own Risk
Use of the Service is at your own risk. The internet is an inherently insecure communications medium, and there are significant security, privacy, and confidentiality risks associated with transmitting information through wired or wireless networks. These risks include, without limitation, unauthorized interception of transmissions, loss or corruption of data, malware, viruses, and other harmful or destructive code.
Rockpoint does not guarantee the security, availability, or reliability of the Service and is not responsible for any loss, damage, or liability arising from your use of the Service, including damage to computers, mobile devices, systems, software, or data resulting from access to or use of the network.
Acceptable Use
You may use the Service only for lawful purposes and in compliance with these Terms of Use and all applicable laws and regulations. Rockpoint reserves the right to monitor network activity, manage bandwidth usage, and suspend, restrict, or terminate access to the Service at any time, without notice, for conduct that Rockpoint determines, in its sole discretion, to be inappropriate, excessive, unlawful, or disruptive.
Prohibited Uses
You may not use the Service to engage in any activity that is illegal, harmful, fraudulent, abusive, or otherwise objectionable, including, without limitation:
- Sending unsolicited bulk or commercial messages, including spam, or engaging in activities that invade another person’s privacy;
- Violating or misappropriating the intellectual property rights of others, including copyrights, trademarks, patents, trade secrets, or other proprietary rights;
- Accessing, attempting to access, or probing computers, systems, accounts, or networks without authorization, including through port scanning, penetration attempts, or other security-testing activities;
- Transmitting or distributing viruses, worms, Trojan horses, malware, ransomware, or other harmful code;
- Engaging in denial-of-service attacks, flooding, mail-bombing, or other activities intended to disrupt network operations or internet access;
- Using peer-to-peer file sharing, torrenting, or other high-bandwidth activities that may impair network performance;
- Forging, altering, or misrepresenting message headers or identifying information;
- Making unauthorized copies of proprietary software or distributing software designed to facilitate spam, hacking, or other prohibited conduct;
- Transmitting defamatory, harassing, abusive, threatening, obscene, indecent, or otherwise unlawful material;
- Distributing pornographic material to minors or engaging in any activity involving child sexual abuse material;
- Violating applicable export control laws or regulations;
- Advertising or promoting fraudulent schemes, including Ponzi schemes, pyramid schemes, or fraudulent offers to buy or sell products or services;
- Selling, reselling, sublicensing, or otherwise providing access to the Service to third parties; or
- Assisting, encouraging, or facilitating any violation of these Terms of Use.
No Warranty
The Service is provided on an “as is” and “as available” basis without warranties of any kind, express or implied. Rockpoint disclaims all warranties, including warranties of merchantability, fitness for a particular purpose, non-infringement, and uninterrupted or error-free operation.
Limitation of Liability
To the fullest extent permitted by law, Rockpoint and its affiliates, officers, employees, agents, and service providers shall not be liable for any direct, indirect, incidental, consequential, special, punitive, or exemplary damages arising out of or related to your use of, or inability to use, the Service.
Changes to These Terms
Rockpoint may modify these Terms of Use at any time without prior notice. Continued use of the Service following any changes constitutes acceptance of the revised Terms.
